“A.   • In Virginia rape prosecutions, there are two alternative elements of proof set forth in Va. Code Ann. § 18.2-61(A)(i) and 18.2-61(A)(ii). Va. Code Ann. § 18.2-61(A)(i) requires the Commonwealth to prove that the defendant had sexual intercourse with the victim, that it was against her will and without her consent and that it was by force, threat or intimidation. Under Va. Code Ann. § 18.2-61(A)(ii), the Commonwealth is required to prove that the defendant had sexual intercourse with the complaining witness and further prove that: (2) at the time, the complaining witness was mentally incapacitated and physically helpless; and (3) at the time of the offense, the defendant knew or should have known the complainant was mentally incapacitated and physically helpless; and (4) the sexual intercourse was accomplished through the use of the complaining witness’s mental incapacity and physical helplessness…
